Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 11.01.2022 in connection with Bhubaneswar P.S. Case No.3 of 2022 corresponding to T.R. Case No.23 of 2022 pending in the Court of learned Sessions Judge-cum-Special Judge, Khurda at Bhubaneswar for the alleged commission of offence under Section 20(b)(ii)(C) of NDPS Act.

Though the prosecution allegation is that total quantity of 34.7 Kg of contraband ganja was recovered from the possession of the petitioner and another accused yet from the copy of the seizure list, enclosed to the bail application, it appears that the quantity of ganja seized from the exclusive and conscious possession of the petitioner is 15.6 Kg.

Considering the above facts and taking into account the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and
conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of the posting of the case without fail.

BLAPL is accordingly disposed of.
