Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 29.04.2022 in connection with Excise Sadar Range P.R.

Case No.04/2022-23 corresponding to 2(a)CC Case No.29 of 2022 pending in the Court of learned J.M.F.C., Dasapalla for the alleged commission of offence under Section 52(a) of the Excise Act, 2008. 4.

Considering the submissions, materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall furnish cash security of Rs.10,000/- (Rupees Ten Thousand). Further, the petitioner shall personally appear before the trial Court on each date of the posting of the case, failing which necessary orders may be passed to take him to custody again by the Court below. Further he shall not leave the territorial jurisdiction of the Court

below without obtaining leave.

BLAPL is accordingly disposed of.
