Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 28.03.2022 in connection with Ainthapali P.S. Case No.167 of 2022 corresponding to T.R. Case No.15 of 2022 of the Court of learned Sessions Judge, Sambalpur for the alleged commission of offence under Sections 21(b)(ii)(C) of NDPS Act, 1985.

It is alleged that the petitioner and four other persons were standing on the road near a car in which contraband ganja weighing 32 kg 200 grams was kept.

It is submitted that the petitioner has no role whatsoever to play in the matter and that they have been apprehended only on suspicion.

Considering the submissions as above, the materials on record and taking into account the period of detention in custody, I am inclined allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in
seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 7.
BLAPL is accordingly disposed of.
