1. Heard Mr. Behera, learned counsel for the Petitioner Order No.
and Mr. Mishra, learned Additional Government Advocate for the State.
2. It is submitted that the representation of the petitioner is pending consideration before the Tehasildar. Thus considering the limited prayer of the Petitioner, the writ petition is disposed of with a direction to the Tahasildar, Baliapal-Opposite Party no.3 to consider the representation of the petitioner filed under Annexure-2 within a period of four months from the date of receipt of copy of this order, after granting opportunity of hearing to the Petitioner as well as alleged encroachers.
3. It is made clear that we have not expressed any opinion on the merits of the case.
4. Urgent certified copy of this order be granted on proper application.
