This matter is taken up through Hybrid mode.

Order dated 5th May, 2022 (Annexure-8) passed by learned Civil Judge (Junior Division), Nimapara in CS No.687 of 1994 (FD) is under challenge in this CMP, whereby objection raised by the Defendants/Petitioners to the salaried Amin's report was rejected,.

In course of hearing Mr. Mohpatra, learned counsel for the Petitioners submits that interest of justice will be best served if Defendants/Petitioners move learned District Judge, Puri to dispose of RFA No.94 of 2002 at an early date, which has been filed against the preliminary decree passed in the aforesaid suit. He, therefore prays for withdrawal of the CMP. 4.

In view of such submission, the CMP is disposed of as withdrawn. If an application for early disposal of the RFA is filed the same shall be considered in accordance with law. (K.R. Mohapatra) Judge s.s.satapathy
