This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.

Learned counsel for the petitioner shows that the petitioner has taken the consent and no other counsel has engaged. Names of Mr. J.K. Panda and associates be deleted.

The petitioner is an accused in G.R. Case No.48 of 2020, on the files of learned Special Judge, Gajapati at Paralakhemundi, arising out of Adava P.S. Case No.79 of 2020, under Sections 20(b)(ii)(C) & 25/29 of the N.D.P.S. Act and is in custody since 07.09.2020.

Taking into account the quantity of contraband seized this Court is not inclined to entertain this application in view of the
statutory bar under Section 37 of the NDPS Act. Accordingly, the same stands rejected.
