This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 6 of 2022 arising out of Salipur P.S. Case No. 139 of 2022, pending on the file of the learned Presiding Officer, Designated Court under the OPID Act, Cuttack, for the alleged commission of offence under Sections 420/426/120-B of the I.P.C. and Sec. 6 of the OPID Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Presiding Officer, Designated Court under the OPID Act, Cuttack, by Order dated 16.05.2022, the present BLAPL has been filed.

Taking into account the submission of the learned counsel for the State that the investigation is continuing, this Court is not inclined to entertain this bail application at this stage, the BLAPL stands rejected.

The petitioner is at liberty to move the learned court in seisin over the matter after filing of the Charge-sheet. The same shall be considered on its own merit without being influenced by the earlier order of rejection or the present order passed by this Court.
