This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as leaned counsel for the State. Perused the F.I.R., Case Diary and other relevant documents.

This is an application under Section 439 of the Criminal Procedure Code.

The petitioner is an accused in G.R. Case No.65 of 2022 corresponding to R. Udayagiri P.S. Case No.53 of 2022 pending in the court of learned J.M.F.C., R. Udayagiri for commission of offence punishable under Sections 447/294/386/506/34, I.P.C. 5.

Learned counsel for the petitioner submits that on similar footing with the present petitioner, other co-accused person has already been released on bail by this Court in BLAPL No.4319 of

// 2 // 2022 by order dated 20.05.2022.

Considering the submissions and the materials available on record, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail. 7.

The Bail Application is accordingly disposed of. Urgent certified copy of this order be granted on proper application.
