This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 03.01.2021 in connection with Semiliguda P.S. Case No.42/2020 corresponding to T.R. Case No.25 of 2020 pending in the Court of learned Addl. Sessions Judgecum- Special Judge, Koraput for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of NDPS Act.

It s alleged that the petitioner was transporting contraband ganja weighing 1640 Kg 100 grams in a six wheeler container while he was apprehended by police. The petitioner appears to have been implicated on the basis of his own confession before police while he was in custody in another case. There is no other material to show his presence at the spot or recovery of the contraband from his possession.

Considering the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the
condition that he shall appear before the trial court below on each date of posting of the case without fail. Further he shall appear before the IIC, Semiliguda Police Station on every Sunday at 10 a.m. till conclusion of trial and such fact shall be certified by the IIC to the concerned court once in every month.

BLAPL is accordingly disposed of.
