This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State as well as learned counsel for the informant.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Baisinga P.S. Case No.47 of 2021 corresponding to C.T. Case No.133 of 2021 pending in the Court of learned J.M.F.C., Betnoti, Mayurbhanj for alleged commission of offences under sections 363/323/506/34 of the Indian Penal Code.

// 2 // In pursuance of the order dated 27.04.2022, the victim has been produced before the Investigating Officer and her 164 Cr.P.C. has been recorded by the learned J.M.F.C., Betnoti. Learned counsel for the State has produced the 164 Cr.P.C. statement of the victim, which is taken on record. On perusal of the statement of the victim, it appears that she has given a clean chit to the petitioner relating to the commission of the offence under which the F.I.R. has been registered.

Learned counsel for the informant has no objection for grant of bail to the petitioner. Considering the submissions made by the learned counsel for the respective parties and the 164 Cr.P.C. statement of the victim and the fact that the petitioner has been granted interim protection since 21.04.2022 and there is no material that he has misutilized his liberty, the interim order dated 21.04.2022 is made absolute.

The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per Rules.
