This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as leaned counsel for the State. Perused the F.I.R., Case Diary and other relevant documents.

This is an application under Section 439 of the Criminal Procedure Code.

The petitioner is an accused in G.R. Case No.111 of 2022 corresponding to Gosaninuagaon P.S. Case No.14 of 2022 pending in the court of learned S.D.J.M., Berhampur for commission of offence punishable under Sections 417/149/420/465/468/469/471/ 120-B/406, I.P.C.

It is alleged that the petitioner was the part of the group, which worked in a company to provide job to the jobless youth. In the process they utilized forged ID cards etc. and collected money.
// 2 // Though preliminary charge-sheet has been submitted, yet the act amount said to have been collected by the petitioner and other accused persons have not been indicated.

Be that as it may, considering the fact that the preliminary charge-sheet has been submitted and taking into account, the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter deem fit and proper to impose including the condition that he shall furnish cash security of Rs.75,000/-(rupees seventy-five thousand) in the shape of short term deport. Such deposit shall be without prejudice to the rival claims of the parties.

The Bail Application is accordingly disposed of. Urgent certified copy of this order be granted on proper application.
