This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State and the informant.

The petitioner is accused in Gania P.S. Case No.34 of 2022 corresponding G.R. Case No.142 of 2022, pending in the file of learned J.M.F.C., Daspalla, under Sections 376(2)(n)/417 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Nayagarh by order dated 20.05.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the 164 Cr.P.C. statement of the victim and keeping in view that charge-sheet has already been filed and considering the period of custody from 22.04.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
