1. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.498-A/302/34, I.P.A. and Section 4 of the D.P. Act.
2. Heard Mr. U.C. Jena, learned counsel for the Petitioner as well as Mr. P.K. Mohanty, learned A.S.C. for the State-Opposite Party.
3. It is submitted that the Petitioner is inside custody since 28.07.2019 and in the meantime the key witness, who is minor daughter of the deceased, has been examined in course of trial as P.W.1, and she has not supported the prosecution case in her evidence.
4. After hearing learned A.S.C. for the State-Opposite Party and upon perusal of the evidence of P.W.1, the minor daughter, I am inclined to release the Petitioner on bail. Accordingly, it is directed to release the Petitioner on bail in connection with
Deogarh P.S. Case No.126/2019 corresponding to S.T. Case No.1/2020 on such terms and conditions to be fixed by the learned Sessions Judge, Deogarh as he deems just and proper including the condition that the Petitioner shall attend the trial court on each date fixed.
5. The BLAPL is accordingly disposed of.
6. An urgent certified copy of this order be granted on proper application.
