Heard learned counsel appearing for the parties. Order No.

Considering the effect of the impugned order and at the same time taking into consideration the grounds raised herein, this Court finds for the impugned order remitting back the matter to the Tahasildar for fresh consideration, grounds raised assailing the order of the appellate authority does not survive. For the opinion of this Court, the matter since remitted back to the Tahasildar for fresh consideration with full opportunity to both side, this Court while declining to interfere in the impugned order disposes of the writ petition directing the Tahasildar, Sadar, Sambalpur-opposite party no.3 to dispose of the remand proceeding entering into fresh consideration but without being influenced by either any order previously passed it or any observation of the appellate authority involved herein.

The writ petition stands disposed of with the above observation only.
