Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 22.01.2022 in connection with Plan Site District Mobile Unit Rourkela P.R. No.272/2021-22 corresponding to 2(a)CC Case No.2 of 2022 pending in the Court of learned 1st Addl. Sessions Judge-cum-Special Judge, Rourkela for the alleged commission of offence under Section 43 of NDPS Act. 4.
It is alleged that the contraband weighing 37 Kg 500 grams was seized from the possession of the petitioner and another persons in the platform of Rourkela Railway Station. The co-accused has been released on bail as per order passed by this Court in BLAPL No.5397 of 2022.

Considering the above facts as also the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall furnish cash security of Rs.50,000/- (Rupees Fifty Thouand). Further he shall appear before the trial court below
on each date of posting of the case, failing which N.B.W. shall be issued against him to take him to custody again. 6.
BLAPL is accordingly disposed of.
