Heard Mr. S. Jena, learned Standing Counsel for School and Mass Education Department for the petitioners. 3.

The petitioners, who are the functionaries of the State, have filed this writ petition challenging the order dated 05.07.2013 passed in O.A. No.1409 of 2013, by which the Odisha Administrative Tribunal, Bhubaneswar, while disposing of the said O.A., has directed the petitioners to reconsider the case of opposite party no.1 in an appropriate Screening Committee as per Rule-14 of the ORSP Rules, 2008 for allowing ACP from the due date after completion of 15 years of service in the same grade or post, as change in scale of pay, i.e. being allowed Trained Matric Scale without change of original grade or post, cannot debar them from being allowed ACP on completion of 15 years of service in the same grade or post.

On query being made by this Court, Mr. S. Jena,

learned Standing Counsel for School and Mass Education Department contended that he has no instructions whether the Screening Committee has been constituted as per Rule-14 of the ORSP Rules, 2008 and he may be granted some time to obtain instructions on that score. But this Court is not inclined to grant adjournment, as it is an old case of the year 2015. However, this Court disposes of the writ petition with a direction that if the screening committee has not been constituted, the same shall be constituted as per Rule-14 of the ORSP Rules, 2008 and case of the petitioner shall be considered as expeditiously as possible.
