This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as the learned Additional Standing Counsel for the State.

This is an application under Section 439 of the Criminal Procedure Code filed by the Petitioner to release him on regular bail in connection with Kishorenagar P.S. Case No.147 of 2021 corresponding to G.R.Case No.788 of 2021 pending in the Court of the learned S.D.J.M., Athamallik for commission of an alleged offence under Sections 379/511 of the Indian Penal Code read with Sections 15(2), 15(4) of PMLA Act, 2011 and Section 3 & 4 of the Explosive Substances Act.

It is submitted by the learned counsel for the Petitioner that the Petitioner damaged the main pipe line of Indian Oil Corporation Limited with the intention of committing theft of petroleum product. However, he was prevented from doing so.

Having regard to the submissions made, the materials on record,

// 2 // the period of detention in custody and the fact that except for damaging the pipe line, no other offence was committed by the Petitioner, this Court is inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
