IN THE HIGH COURT OF ORISSA AT CUTTACK

CONTC No.366 of 2007 Dr. Lakshmi Kanta Pradhan ....

Petitioner Mr. Gokulananda Mohapatra, Advocate -versusSanjaya Kumar Das Barma and others ....

Opposite Parties

CORAM:

THE CHIEF JUSTICE JUSTICE R. K. PATTANAIK

ORDER

25.04.2022 Order No.

03.

1. The present petition was filed way back in 2007. It did not come up for hearing for more than 10 years thereafter. On 12th July 2017, when it was listed, the following order was passed:

"As prayed, list it after two weeks so as to enable learned counsel for the Petitioner to obtain fresh instructions in the matter.

List it after two weeks along with record of O.J.C. No.5752 of 2002."

2. Learned counsel for the Petitioner did not bother to get those instructions and get the matter listed. Today, when the present petition is listed in its turn in due course, learned counsel for the Petitioner appears before the Court without the paper book and with a few slips of papers. When asked how could he appear by producing slips of paper, learned counsel for the Petitioner states that the paper book is misplaced.

3. The Court sees no reason why any indulgence should be granted to the Petitioner in this state of affairs. The present petition is accordingly

dismissed. As and when learned counsel for the Petitioner is able to locate his paper book, he can file an appropriate application supported by proper affidavit, for directions.

(Dr. S. Muralidhar) Chief Justice (R. K. Pattanaik) Judge S.K. Guin
