Heard learned counsel for the Parties.

The Original Application involves the following prayer :- "The Hon'ble Tribunal be pleased to direct the State respondents to extend the promotional pay benefit to the applicant by passing necessary orders in the said regard from the date of his eligibility, i.e., keeping in view the date of his passing the B.Ed. or from the date of his joining service, whichever is later and on the said basis, to fix his pay in the promotional post of Junior SES grade till he got his promotion to Junior SES grade on 1.12.1981, as has been given to his junior respondent No.4 and accordingly, to bring forward his pay in such scale and corresponding pay scales of Junior SES grade by way of fixation of his pay, as has been done in case of his junior and the Hon'ble Tribunal be further pleased to direct that the applicant shall be given all future service benefits on the said basis and the Hon'ble Tribunal be pleased to pass such other order/orders as is deemed fit and proper in the facts and circumstances of this case."

Though the Original Application was entertained in the Tribunal and registered, in spite of service of copy of the Application on the O.Ps., there is no counter to the claim of the Petitioner as of now. 4.
Keeping in view that there is no counter for so many years, however taking note of the request involved herein, this Court disposes of the Writ Petition with direction to the competent authority to look into the request of the Petitioner and the relief sought for and take decision and also taking the plea taken in the Writ Petition by completing the entire exercise within a period of three months from the date of communication of this order. It is will be open to the Petitioner to serve a copy of this order along with copy of the Writ Petition on the competent authority within ten days hence.
