This matter is taken up through Hybrid arrangeme (video conferencing/physical mode).

Heard learned counsel for the parties.

This Writ Petition has been filed with the following prayer:

"The petitioners, therefore, most respectfully pray that the Hon'ble Court may be graciously be pleased to admit the Writ Petition, issue rule "NISI" to the Opposite parties particularly Opp. Party No.3 asking him to show cause as to why he shall not be directed to consider and dispose of the application under Annexure-2 within a time stipulated by this Hon'ble Court;

And on their failing to show cause or showing insufficient cause make the rule absolute;

And pass such other Writ/writs, order/orders and directions that would be deemed just and proper

// 2 // in the facts and circumstances of the case;

And for this act of kindness, the petitioner shall as in duty bound, ever pray."

Learned counsel for the petitioners submitted that that though highlighting their grievances, the petitioners have filed an application on 02.02.2022 before the Tahasildar -cum- L.A.O., OTPCL, Kamakhyanagar, opposite party no.3 in the pending L.A. Case No. 25 of 2011 annexed as Annexure-2 to the Writ Petition, but till date no decision has yet been taken on the same. In such background, they pray that a direction be issued to Opposite Party No.3 to take a decision on the above noted application within a specific time period.

Learned counsel for the State has no objection to such prayer.

Considering the submissions made and in view of the limited nature of relief sought for, without expressing any opinion on the merits of the case, this Court directs Opposite Party No.3 to take a decision on the above noted application under Annexure-2 in accordance with law within a period of three months from the date of receipt of this order after giving opportunity of hearing to the petitioners and communicate the result of such exercise to the petitioners.

// 3 // With the aforesaid direction, the Writ Petition stands disposed of.

Issue urgent certified copy as per Rules.
