This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This Writ Petition has been filed by the petitioner Kasinath Dhanwar with a prayer to quash the order dated 26.11.2021 under Annexure-2 and letter No.4240 dated 29.11.2021 under Annexure-3 issued to opposite party no.8 as highest bidder by the Tahasildar, Lathikata (opposite party no.5).

Mr. Rath, learned counsel for the petitioner submitted that there is acceptance of invalid Solvency Certificate in connection with Balanda Stone Quarry-14

// 2 // of MouzaBalanda, Khata No.506, Plot No.2473/P, Kissam- Pahad, Area- Ac.7.00 for the year 2021-22 and highlighting the illegalities, the petitioner has filed a representation before the Tahasildar, Lathikata under Annexure-9 on 29.11.2021 but the same has not yet been considered and he may be given an opportunity of hearing before the Tahasildar so that he will highlight the same. Learned counsel for the petitioner further submitted that in pursuance of Annexure-3, no agreement has been executed till date.

Learned counsel for the State submitted that he has no objection, if the representation is considered within a stipulated time.

Considering the submissions made by the learned counsel for the respective parties and in view of the limited nature of grievance of the petitioner, the writ petition is disposed of directing the opposite party no.5 the Tahasildar, Lathikata to consider the representation of the petitioner under Annexure-9 and dispose of the same within a period of two weeks from today after giving an opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner.

The opposite party no.5 shall act upon the certified copy of the order produced before him with the copy of the writ petition.
