Heard learned counsel appearing for the parties. 2.

This writ petition involves the following prayer: "The petitioner, therefore, prays that Your Lordship's may graciously be pleased to admit the application, call for the records from the opp. party no.3 and 4 and after hearing the parties direct the opp. party no.4 to comply the directions made by the opp. party no.2 to opp. party no.4 and initiate a proceeding to do the needful to correct the area of the petitioner as detailed in Annexure-4 within a particular time.

And for this act of kindness the petitioner shall, as in duty bound ever pray."

Even in spite of repeated direction, there was no outcome. Finally by order dated 25.07.2022 this Court while giving last opportunity also directed the Officer concerned to appear in Court in the event he is unable to provide response to the allegation of the petitioner. In course of hearing today, it has been brought to the notice of the Court by opposite party no.4, who is also present in Court in person through I.A.No.1075 of 2022 that relevant file is not traceable. Opposite party no.4 however makes an undertaking to discharge his responsibility, if the petitioner provide certified copy of relevant documents, find the file reconstituted and decision, as appropriate, can be undertaken within a limited period of time. 4.

Mr.Bose, learned counsel appearing for the petitioner has no objection to the request of opposite party no.4 and undertakes to provide

// 2 // relevant documents within a period of two weeks hence. In the event of filing of such document with application involved herein for necessary exercise within two weeks hence, the opposite party no.4 shall do well in undertaking the exercise at least within a period of six weeks thereafter. Petitioner undertakes to cooperate the opposite party no.4. Personal appearance of the opposite party no.4 is no more required. 5.
