This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Learned counsel for the State on instruction submitted that petitioner no.2 Sudhansu Sekhar Das has been taken into judicial custody.

In view of such submission, this anticipatory bail application so far as petitioner no.2 is concerned has become infructuous and stands disposed of.

Heard the learned counsel for the petitioner no.1 and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner no.1 in connection with G.R. Case No.768 of 2022 arising out of Sundargarh Town P.S. Case No.178 of 2022 pending in the

// 2 // Court of learned S.D.J.M., Sundargarh for alleged commission of offences under sections 294/506/427/307/ 379/34 of the Indian Penal Code.

Perused the first information report annexed to the anticipatory bail application.

Learned counsel for the State submitted that one Mithu Mahanandia is the injured in this case and he has sustained simple injury, however petitioner no.1 has got five numbers of criminal antecedents.

Learned counsel for the petitioner no.1 submitted that in all those cases, petitioner no.1 is on bail. Considering the submissions made by the learned counsel for the respective parties and in view of the criminal antecedents against the petitioner no.1, while not inclining to grant anticipatory bail to the petitioner no.1, it is observed that in the event the petitioner no.1 Krishna Gupta surrenders in the Court below within a period of four weeks from today and moves for bail, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law. The case records shall be made available to the Court concerned for adjudication of the bail application.

The ABLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
