CORAM:
JUSTICE BISWANATH RATH
ORDER
15.07.2022 03.
1.
This writ petition involves the following prayer :- Order No.
"That the petitioner therefore prays that the Hon'ble Court may kindly be pleased to admit the writ petition and call upon the opposite parties to show cause and upon their failure to show cause or showing insufficient cause may further be pleased to direct the Opp. party no.-5 to correct the R.O.R. and record the same name of the petitioners within a short stipulated period." 2.
Referring to the communication at Annexure-6 learned counsel for the Petitioners submitted that the Petitioners have a valid case for correction of record of rights. When the matter was earlier heard, the Petitioner was asked to show foundation requiring correction in the record of rights.
3.
Today learned counsel for the Petitioners produces a copy of the order passed in the Land Record Case No.395/75 on 18.09.1978 thereby giving a direction for preparation of the record of rights in the manner prescribed therein. Looking to the representation of the Petitioners at Annexure-6, it appears, there is clear disclosure of
// 2 // production of copy of such document before the competent authority. Keeping this in view, this Court disposes of this writ petition directing the Tahasildar, Ganjam to take a lawful decision on the representation of the Petitioners at Annexure-6 keeping in view the development through the order dated 18.09.1978 involving the Land Record Case No.395/75, provided there is no interference in such order by any higher forum.
4.
The entire exercise shall be completed within a period of two months from the date of communication of an authenticated copy of this order by the Petitioners.
5.
The writ petition stands disposed of.
