This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.672 of 2021 converted to S.T. Case No.136 of 2021, pending on the files of learned 2nd Additional Sessions Judge, Khurda, arising out of Khordha Model P.S. Case No.238 of 2022, under Sections 302/379/34 of IPC and is in custody since 16.06.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Khurda, by order dated 12.05.2022 in the aforementioned case, the present BLAPL has been filed.

It is the case of the prosecution that there are three eye witnesses of the incident namely Jugal Charan Muduli, Ranjan Muduli and Kulamani Muduli was since been examined as P.Ws. 1,2 and 3 and have resiled from the statement.

Taking note of the same and release of the co-accused by order dated 06.04.2022 by this Court in BLAPL No.8263 of 2021, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

According, the BLAPL stands disposed of.
