This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 17.04.2022 in connection with Cyber P.S. Sambalpur Case No.17 of 2022 corresponding to G.R. Case No.1284 of 2022 pending in the Court of learned S.D.J.M., Sambalpur for the alleged commission of offence under Sections 419/420/467 of IPC read with Section 66(C)/66(D) of I.T. Act.

It is alleged that the petitioner conspired with the other accused persons to defraud the informant by utilizing his PAN Card and debited huge amount from such account. The matter came to light in an inquiry held by the Income Tax Department. As it appears, the petitioner has not been named in the F.I.R. and he appears to have been implicated only on the basis of his so called confession before police. There is no other material showing

his direct involvement in the occurrence. That apart, other accused persons similarly placed have been released on bail as per order by this Court in BLAPL No. 4545 of 2022 and BLAPL No. 4715 of 2022.

Considering the above facts, the materials on record and taking into account the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
