This matter is taken up through hybrid arrangement (virtual/physical mode.) 2.

Heard learned counsel for the Petitioner and learned counsel for the State.

It is submitted on behalf of the Petitioner that the Petitioner is an accused in G.R. Case No.134 of 2012 in connection with Jeypore Town P.S. Case No.36 of 2012, pending in the court of C.J.M.-cum-A.S.J., Jeypore, for commission of alleged offences under Sections 409/420/379 of I.P.C. It is submitted that accused is on court bail and on 06.04.2022 since he remained absent and step was not taken on his behalf by the concerned Advocate, N.B.W./A of arrest was issued against the Petitioner. The said order is under challenged before this Court.

It is also submitted that due to communication gap, the

// 2 // Petitioner could not attend the court.

Considering the submission, it is directed that the order dated 06.04.2022, passed by the CJM-cum-ASJ, Jeypore, for issuance of N.B.W./A of arrest against the Petitioner is set aside subject to cash security of Rs.5,000/- (Rupees Five thousand) and Petitioner is given liberty to surrender before the aforesaid court in G.R. Case No.134 of 2012 within a period fortnight hence, which shall be dealt with in accordance with law.

The CRLMC is accordingly disposed of.
