1. In the absence of anyone appearing for the contesting Opposite Party No.2 and in the absence of a settlement between the parties, it is not possible for this Court at this stage to interfere in the matter under Section 482 Cr.P.C., particularly when the trial was already in progress when the interim order dated 1st December, 2018 was passed by this Court. As a result of the said interim order the trial has not progressed.

2. Consequently, while vacating the said interim order, the Court requests the trial Court to now proceed expeditiously with the trial, and conclude it within a period of three months and in any event not later than 6th February, 2023. It is clarified that it would be open to the Petitioner to urge all the pleas raised in the present petition at the appropriate stage in the trial Court.

3. The petition is accordingly disposed of. A copy of this order be communicated to the subordinate Court concerned forthwith. (Dr. S. Muralidhar) Chief Justice M. Panda
