Heard learned counsel for the petitioner as well as learned Addl. Government Advocate for the State of Odisha.
The petitioner Satyasai Medical College, Hospital and Research Centre, Bhubaneswar has filed this writ petition challenging the order dated 13th May, 2022 passed by the Director, Directorate of Ayush, Bhubaneswar, Odisha. In the operative portion of the said order, the Director has held as follows:- "Now, considering the above facts and in compliance to the directions of the Hon'ble High
// 2 // Court, Orissa, it is hereby ordered that the previous application of the petitioner bearing no.SMC/300/2022, dt.15.02.2022 for obtaining recognition/approval of the college, situated at Uttampur, Cuttack has become null and void on account of non-compliance to the Directorate letter no.2448, dt.13.04.2022 & change of premises of the college from Cuttack to Bhubaneswar and hence rejected. He is advised to apply afresh with the prerequisites, if he desires so, for obtaining recognition/approval of the college in the new premises at Bhubaneswar which shall be considered after due physical verification and compliance of the guidelines of the State Government in this regard."
The reason assigned by the Director appears to be sound and there is no illegality and infirmity in the same. Learned counsel for the petitioner submitted that the petitioner will file a representation before the opposite party no.2 in appropriate form within a period of two weeks from today and the same may be directed to be disposed of at an earliest giving opportunity of hearing to the petitioner.
Considering the limited nature of grievance raised by the petitioner, the writ petition is disposed of directing the petitioner to file a representation before the opposite party no.2- the Director, Directorate of Ayush, Bhubaneswar, Odisha within a period of two weeks from today. In case such a representation is filed, the opposite
// 3 // party no.2 shall consider the same within a period of two weeks from the date of submission of the representation after giving an opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner. Urgent certified copy of this order be granted on proper application.
A free copy of this order be handed over to the learned counsel for the State.
