This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Tangi P.S. Case No.158 of 2019 corresponding to G.R. Case No.215 of 2019 pending in the Court of learned N.G.N -J.M.F.C., Tangi for commission of the alleged offences punishable under sections 498-A/304-B/306/406/34 of the Indian Penal Code.

Perused the first information report annexed to the anticipatory bail application.

// 2 // Learned counsel for the petitioner submitted that the petitioner is the brother-in-law of the deceased and there are no materials against the petitioner so as to attract the ingredients of the offence under which the case has been registered and therefore, the anticipatory bail application of the petitioner may be favourably considered.

Learned counsel for the State opposed the prayer for bail.

Considering the submissions made by the learned counsel for the respective parties, the nature and gravity of the accusation against the petitioner, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders and moves for bail in the Court below within a period of four weeks from today, the same shall be disposed of by the learned Courts below in accordance with law expeditiously and if any coaccused has been released on bail in the meantime, the claim of parity shall be taken into account. The case records be made available before the Court concerned for adjudication of the bail application. The ABLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
