This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Brajarajnagar P.S. Case No.304 of 2021 corresponding to G.R. Case No.2438 of 2021 pending in the Court of learned S.D.J.M., Jharsuguda for alleged commission of offence under section 420 read with section 34 of the Indian Penal Code. Perused the F.I.R.
Learned counsel for the State on instruction submitted that the cheating amount involved in the
// 2 // case is Rs.16,32,000/- (sixteen lakh thirty two thousand) which has been transferred to the account of three persons, namely, Satyabrata Jena, Srinibas Pradhan and Durgadutta Tripathy and nothing is available on record to show that any money has been transferred to the petitioner's account or he has received any money.
He further submitted that the co-accused Satyabrata Jena and one Gyanaranjan Das have been served with notices contemplated under section 41A of Cr.P.C.
Considering the submission made by the learned counsel for the petitioner and taking into account the fact that the petitioner is a Government servant and the offence is triable by Magistrate, the interim order dated 29.06.2022 is made absolute. The ABLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
