This matter is taken up through hybrid arrangement (virtual/physical mode.) 2.

Heard learned counsel for the Petitioners and learned counsel for the State.

It is submitted on behalf of the Petitioners that the Petitioners are accused in G.R. Case No.12 of 2018 (S.C. & S.T. (POA) Act), arising out of Nuagaon P.S. Case No.55 of 2018, pending in the court of Special Judge-cum-District & Sessions Judge, Ganjam, Berhampur, for commission of alleged offences under Sections 341/294/452/323/354-B/ 379/506/34 of I.P.C. r/w Section 3 (1)(r) /3(1)(r)(s)/ 3(1)(w)(ii)/3(2) (va) of SC & ST (POA) Act. It is submitted that accused persons are on court bail and on 4.10.2019 since they remained absent and steps were not taken on their behalf by the concerned Advocate, N.B.W.A. was issued against the

// 2 // Petitioners. The said order is under challenged before this Court.

It is also submitted that due to communication gap, the Petitioners could not attend the court.

Considering the submission, it is directed that the order dated 4.10.2019, passed by the Special Judge-cum-District and Sessions Judge, Ganjam, Berhampur, for issuance of N.B.W.A of arrest against the Petitioners is set aside subject to cash security of Rs.2,500/- each and Petitioners are given liberty to surrender before the aforesaid court in G.R. Case No.12 of 2018 within a period fortnight hence, which shall be dealt with in accordance with law.

The CRLMC is accordingly disposed of.

Issue urgent certified copy as per rules.
