1. WP(C) No. 13678 of 2022 & I.A. No. 7261 of 2022

1. This matter is taken up by hybrid mode.

2. In view of the limited nature of prayer made by the petitioners and the submissions made at the Bar, the writ petition is disposed of at the stage of admission without issuing notice to O.P. No.3.

3. The petitioner shall file a properly constituted appeal under Section 274 of Odisha Municipal Act, 1915 within three weeks along with a petition for interim direction before the appellate authority.

4. On filing of the same, the authority shall consider the same and pass appropriate order in accordance with law by giving an opportunity of hearing to all the necessary parties.

5. There shall be stay of operation of the order of eviction as at Annexue-2 dated 25.5.2022 till disposal of the interim application by the authority.

6. The writ petition is disposed of accordingly.

7. It is clarified that this Court has not expressed any opinion regarding merits of the case in any manner whatsoever.

Urgent certified copy of the order may be granted on proper application.
