This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This is an application U/S. 439 of Cr.P.C. by the Petitioner for grant of bail in connection with Bhandaripoikhari P.S. Case No.22 of 2022 corresponding to G.R.Case No.165 of 2022 pending in the Court of learned S.D.J.M., Bhadrak for commission of offence punishable U/Ss. 498-A/294/304-B/506/306/406 of the I.P.C. read with Section 4 of D.P. Act on the allegation of committing dowry death and abetting suicide of the deceased.

In the course of hearing of the bail application, learned counsel for the petitioner by placing the statement of the informant and other witnesses as well as F.I.R. submits that all the allegations appearing against the petitioner are improbable and the petitioner has been falsely implicated in this case and accordingly, he prays to enlarge the petitioner on bail.

Learned counsel for the State, however, opposes the bail application of the petitioner by placing the F.I.R. and statement of the informant. At this stage, learned counsel for the petitioner seeks permission of the Court to withdraw the bail application with liberty

// 2 // to renew his prayer for bail before the trial Court after commitment. 5.

In view of the aforesaid prayer and rival submissions, the BLAPL is disposed of as withdrawn with liberty to the petitioner to renew his prayer for bail before the Court in seisin of the case after commitment.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of the order be granted on proper application.
