This matter is taken up hybrid arrangement (virtual/physical) mode.

The Petitioners having been implicated in connection with Jenapur P.S. Case No.134 of 2021 corresponding to C.T. Case No.734 of 2021 registered for alleged commission of offence under Section-341/294/323/325/506/34 of the IPC, pending on the file of learned SDJM, Dhenkanal, have filed this application under section438 of the Cr.P.C. for grant of anticipatory bail in the above mentioned case.

Heard learned Counsel for the Petitioners and learned Counsel for the State.

Considering the submissions and on going through the materials on record as also other surrounding circumstances; further taking into account the criminal antecedents of the Petitioners, while being not inclined to grant of anticipatory bail to the Petitioners, this application is disposed of with the observation that when the occasion would so arise before the learned Court in seisin of the case for consideration of the prayer for grant of regular bail
// 2 // to the Petitioner, the same would be made on its own merit; further taking into account the factum of release of co-accused persons on bail, if similarly situated with the Petitioners on the ground of parity as per law and disposed of early in accordance with law. 5.
The ABLAPL is accordingly disposed of.
Interim order passed on 02.06.2021 does no more survive. Issue urgent certified copy as per rules.
