This matter is taken up through Hybrid mode.

Petitioners in this CMP seek to assail the order dated 24th May, 2022 passed by learned Civil Judge (Senior Division), Soro in CS No.333/216 of 2022 (I), whereby a petition under Section 80(2) CPC was rejected.

Taking into consideration the submission of learned counsel for the Petitioners, this Court, vide order dated 20th June, 2022 directed learned State Counsel to take instruction. 4.
Mr. Mishra, learned ASC on instruction from Tahasildar, Bahanaga submits that due to pendency of litigation there is no proposal for eviction.
