This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned counsel for the State.

The I.A. has been filed for modification of the order dated 15.07.2022.

While disposing of the writ petition, this Court quashed the Enquiry Report under Annexure-21 with further direction to the Disciplinary Authorities to conduct DP by supplying relevant documents to the petitioner, which are likely to be used against him in the proceeding and further directed to provide opportunity of hearing to the petitioner.

Further, after considering the submissions made by learned counsel for the petitioner that the DPC is going to be convened this Court has directed to consider the case of promotion of the petitioner and follow the sealed cover procedure. It is stated by learned counsel for the petitioner that although the DPC is convened, the case of the
// 2 // petitioner has not considered by the said DPC. He further submits by learned counsel for the petitioner that similarly situated persons with the present petitioner and also juniors of the petitioner have already been given promotion by the DPC. However, this Court had already given direction to the DPC to consider the case of the petitioner for promotion in accordance with law and rules by adopting sealed cover method and if the petitioner is aggrieved, it is open for the petitioner to approach this court by filing appropriate application, if he is aggrieved by the compliance of the order, it is open for the petitioner to file contempt petition.

The I.A. is disposed of accordingly.
