1. The secured creditor/Bank is seeking mandamus directing the Collector-cum-District Magistrate, Khurda for deciding the application filed on 25th April,2022 within a time frame under Section 14 of the SARFAESI Act by the petitioner for providing official assistance for securing the actual physical possession of the mortgaged property offered as a collateral security to secure the outstanding liabilities of housing loan raised by Mr.Jaydev Sahoo/opposite party no.3.

2. Mr. Mohanty, learned Additional Standing Counsel upon instruction states that the officer concerned/ opposite party no.2 shall decide the application within two months from today.

3. In response, learned counsel for the petitioner states that the present petition can be disposed of in view of the aforesaid stand of the opposite party no.2.

Opposite party no.2 is directed to ensure the said application be decided on or before 31st of January,2023.
