This matter is taken up through hybrid arrangement (virtual/physical mode).

Learned counsel for the Petitioners prays for withdrawal of this application insofar as the Petitioner No.1 is concerned seeking leave to file the same afresh in case necessity so arises in future. Granting the liberty as aforesaid, this application stands disposed of insofar as the Petitioner No.1 is concerned. The ABLAPL is now confined to Petitioner Nos.2 and 3hereinafter referred to as 'the petitioners'.

The Petitioners having been implicated in C.T. Case No.426 of 2021 arising out of Th. Rampur P.S. Case No.43 of 2021 registered for alleged commission of offence under sections 420/467/468/34, I.P.C. pending in the Court of the learned S.D.J.M., Bhawanipatna, have filed this application under section 438 Cr.P.C. for grant of bail in the event of their arrest in the said case.

Heard learned counsel for the Petitioners and learned counsel for the State.

Considering the submissions and on going through the nature of accusations; further keeping in view the surrounding circumstances of the case as also concerning the Petitioners; it is directed that in the event the Petitioners surrender before the court in seisin of the case in connection with the afore-mentioned case within three weeks hence and moves for their release on bail, they shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.

The ABLAPL is accordingly disposed of.
Issue urgent certified copy as per rules.
