This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner has submitted the order dtd. 18.02.2015 by which N.B.W. was issued and it is assailed in the present CRLMC by way of memo after serving a copy thereof to the learned counsel for the State. The same is taken on record.

Being aggrieved by the Order dtd.18.02.2015 passed by the Learned J.M.F.C., Salipur in G.R. Case No. 430(A) of 2012 issuing NBW against the petitioner for non-appearance on the date
fixed. The present CRLMC has been filed under Section-482 Cr.P.C.

Considering the recitals in the CRLMC petition and submission of the learned counsel for the parties, this Court does not find any infirmity in the impugned order. Yet, to enable the petitioner to effectively defend his rights, this Court directs that on surrendering within a period of three weeks hence, the petitioner shall be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter. The impugned order is set aside.

It is needless to state here, in the event the petitioner does not surrender within the time specified, this order shall stand recalled and it shall be open for the Learned Court below to take steps to enforce the impugned order.

The CRLMC stands disposed of.
