This matter is taken up through Hybrid arrangement (video conferencing/physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application for grant of anticipatory bail under section 438 of Cr.P.C. in connection with Baliapal P.S. Case No.49 of 2022 corresponding to C.T. Case No. 139 of 2022 pending in the file of learned J.M.F.C., Basta for alleged commission of offence under section 376 of the Indian Penal Code. Perused the F.I.R. annexed to the anticipatory bail application.

In view of the nature and gravity of the accusation and since the case is one under section

// 2 // 376 of the Indian Penal Code and the victim, who is the informant in the case has implicated the petitioner in the commission of rape, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner appears in the Court below within a period of four weeks from today and moves for bail before the learned Court below, the same shall be disposed of as expeditiously as possible by the Court below in accordance with law. The case records shall be made available to the Court concerned. The ABLAPL stands disposed of.

Issue urgent certified copy as per Rules.
