Heard learned counsel for the petitioner and learned Addl. Government Advocate for the State.

In course of hearing it is brought to notice of this Court that challenging the order of eviction, the petitioner has approached the Collector, Angul in Revision Case No. 19 of 2021, which is said to be pending.

Considering the fact that the appeal is pending before the appropriate authority, it would not be proper for this Court to enter into the controversy at this stage, more so, when law also permits the appellant to seek stay of the order of eviction by filing appropriate application before the appropriate authority.

Considering the above, the writ petition is disposed of granting liberty to the petitioner to move the appellate Court by filing appropriate application seeking stay of eviction within a period of two weeks from the date of receipt of

certified copy of this order. Till such time, status quo be maintained over the land in question.

6.

Issue urgent certified copy as per rules.
