This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with Special Case No. 74 of 2020 corresponding to Oupada P.S. Case No. 24 of 2019, pending on the file of the learned Special Judge-cumA.D.J.,-1 (POCSO), Balasore for the alleged commission of offence under Sections-363 / 366 / 376(3)/294/323/506 of the IPC read with Section-6 of the POCSO Act, and is in custody since 19.06.2020.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Special Judge-cum-A.D.J.,-1 (POCSO), Balasore by Order dtd. 22.04.2021 in Special Case No. 74 of 2020, the present BLAPL has been filed.

Heard Mr. D.S. Ray, learned counsel for the petitioner and Mr. K.K. Gaya, learned Additional Standing Counsel for the State and Mr. Vivekand Jena, learned counsel appearing for the Informant.

Perused the 164 Cr.P.C statement and the Medical Examination Report of the victim. Considering that, the petitioner is in custody since 19.06.2020 and the charge-sheet of the case has been filed in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.
