Learned counsel for the State on instruction submitted that no first information report has yet been registered against the petitioner in Fategarh police station.

Since there is no apprehension of arrest of the petitioner, I am not inclined to entertain the application under section 438 of Cr.P.C.

The petitioner is at liberty to seek appropriate remedy after the registration of the F.I.R.
