This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel for the petitioner is permitted to withdraw the bail application to move the learned court below afresh, since at the time of consideration by the learned Court below the investigation was in progress.

Granting such liberty the BLAPL stands disposed of as withdrawn.

5.

It is needless to say that the bail application if filed afresh shall be considered on its own merits either by the earlier passed by the learned Court below or by the withdrawal of the present bail application.
