This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with Special G.R. Case No. 58 of 2022 arising out of Fategarh P.S. 95 of 2022, pending on the file of the learned Special Judge-cum-Sessions Judge, Nayagarh for the alleged commission of offence under Section- 20(b)(ii)(B) of the N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Special Judge-cum-Sessions Judge, Nayagarh by Order dtd. 24.05.2022 in Special G.R. Case No. 58 of 2022, the present BLAPL has been filed.

It is stated in the impugned order that the contraband (Ganja) being carried is (14 Kgs) admittedly less than commercial quantity.

Taking into account, the period of custody and noncommencement of Trial, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The Bail Application thus stands disposed of. 8.
