Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Industrial Nisha P.S. Case No.54 of 2009 corresponding to C.T. Case No.1908 of 2009 pending in the court of learned J.M.F.C., Chhendipada for alleged commission of offences under sections 452, 323, 454, 427, 379, 380 read with section

// 2 // 34 of the Indian Penal Code.

In view of the nature and gravity of the accusation against the petitioners and since it is a case of the year 2015 and the petitioners have approached this Court almost after seven years of the lodging of the first information report, while not inclining to grant anticipatory bail to the petitioners, it is observed that in the event the petitioners surrender in the Courts below within a period of four weeks from today and move for bail, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case records be made available before the Court concerned for adjudication of the bail application.

The ABLAPL stands disposed of.

Urgent certified copy of this order be granted on proper application.
