This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Bargarh P.S. Case No.591 of 2021 corresponding to C.T. Case No.1383 of 2021 pending in the Court of learned S.D.J.M., Bargarh for commission of the alleged offence punishable under section 306 of the Indian Penal Code.

The earlier bail application of the petitioner in ABLAPL No.16488 of 2021 has been rejected as per the order dated 25.01.2022.

// 2 // Learned counsel for the petitioner submitted that the earlier anticipatory bail application has been disposed of basing on the submission made by the learned counsel for the State that the petitioner is having two criminal antecedents which is not correct, in fact the petitioner is having one criminal antecedent.

Considering the submission made by the learned counsel for the respective parties, I find there is nothing to take a different view than the view taken in the earlier anticipatory bail application. However, the surrender period is extended till the end of July 2022 and while considering the bail application, both the Courts shall take into account the fact that the petitioner is a lady and keep in view the proviso to section 437(1) of Cr.P.C.

The ABLAPL stands disposed of.
