This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Sambalpur Sason P.S. Case No.96 of 2013, corresponding to G.R. Case No.1964 of 2013 in S.T. Case No.33/10 of 2014, pending in the file of learned Addl. Sessions Judge, Sambalpur, for commission of alleged offence under Sections 307/302/34 of I.P.C. 3.
Pursuant to order dated 22.07.2022, a report from the learned Addl. Sessions Judge, Sambalpur in S.T. Case No.33/10 of 2014 was received by this Office, which is placed at Flag-A of the bail application. On perusal of the said report, it is found that the report does not reveal the reasons for delay in disposal of S.T. Case No.33/10 of 2014 but it seems to be in the nature of a calendar statement.

Heard learned counsel for the Petitioner and learned counsel for the State.

In this case, as most of the witnesses have been examined in the meantime and even though Petitioner is languishing custody since 2013, which is more than 9 years, but till date trial has not been concluded, this Court directs trial Court to release the petitioner on bail on such terms and conditions as deemed just and proper.

Accordingly, the BLAPL stands disposed of being allowed.
