This matter is taken up through hybrid arrangement.
1. The present contempt has been filed for alleged non-disbursement of the enhanced compensation awarded by the Reference Court on the application under Section 18 of the old Land Acquisition Act, 1894 in spite of positive directions by this Court on 18th November, 2020.
2. At the time of hearing, Mr. Mohanty has placed on record a photocopy of the Memo dated 26th October, 2022 issued by Shri Alok Kumar Kar, IAS, Director R & R & Ex-Officio, Addl. Secretary to Govt. addressed to the Office of the Advocate General, wherein it is stated that the admissible amounts of enhanced compensation have since been ascertained and deposited with the Special Land Acquisition
// 2 // Officers concerned. He further states that necessary payments shall be made within next 15 days.
3. Learned counsel for the State based on the aforesaid letter, which has been retained for the purpose of record, assures the Court that necessary disbursement shall be made within 30 days from today.
4. In view of the above, the CONTC is disposed of. It is clarified that in case necessary payments are not made within 30 days, the Officer concerned may make himself liable to pay exemplary costs of Rs.50,000/- from his own account to the petitioner. (Jaswant Singh) Judge (M.
